What is the binding opinion for and when do you request it?

The capital of the Slovak Republic, Bratislava, issues the binding opinion of the capital of the Slovak Republic, Bratislava, as the professional basis for proceedings conducted at the building authority of the relevant city district.

In the binding opinion, the capital city, as a spatial planning authority, applies the binding content of the spatial planning documentation, especially the principles and regulations of the binding part of the spatial planning documentation and, as the relevant authority, other interests that may follow from special regulations.

Builders submit it to the building authority of the relevant city district as part of the relevant permit-granting procedure together with various opinions of the relevant authorities and organisations.

The capital of the Slovak Republic, Bratislava, issues a binding opinion for proceedings pursuant to § 140d for existing built and used buildings, if their suitability is surveyed in the territory where the lowest level of land-use planning documentation was approved.

Assessment of compliance with approved spatial planning documentation

• in relation to the Territorial Plan of the Capital of the Slovak Republic, Bratislava, 2007, as amended (ÚPN). The submission must contain an assessment of compliance in terms of the valid regulation according to the ÚPN, particularly in terms of the intensity of land use and in terms of functional land use, and it is necessary to distinguish whether the building is located in developing areas or in stabilised areas. • and at the same time in relation to the relevant spatial plan of the zone (ÚPN-Z) (if such a spatial planning basis exists for the given territory)

Transport solution

Data on the requirements of the building for the traffic connection, or of the resolved area to the public communication network (mark all entrances to the land and entrances to the object), including parking and a proposal for connecting the building to the transport facilities of the area.

As part of the transport solution, a transport drawing must be submitted that includes the transport connection with appropriate dimensioning, width arrangement of communications (the existing condition, including the design), technical parameters to be proposed in line with the relevant, currently valid STN.

Allow us to notify you that as of 1 April 2024, new legislation is in force, according to which the competency of the spatial planning authority is crucial for the issuing of a binding opinion.

In the case of proposed constructions and their changes, the capital city shall issue a binding opinion on other than simple constructions. In order for the deadline to start, it is necessary that the applicant deliver an application for a binding opinion with identical project documentation to the capital city and the relevant city district, which has the opportunity to comment.

•In the case of surveying and authorising existing buildings and changes in their use without construction modifications, the spatial planning authority that approved the lowest level of spatial planning documentation shall issue a binding opinion. The applicant shall deliver the application only to the relevant spatial planning authority.

How to apply for a binding opinion?

The application (form) can be submitted: • electronically ↗︎: the form can be sent together with the necessary attachments after logging in to the “Bratislava account”. Attachments must contain a graphic scale and should be in an unlocked and unencrypted .pdf vector format (in exceptional cases in .dxf format),

physically – in the case of paper submissions, it is necessary to bring 3 pairs of project documentation. Paper applications can be brought physically to City Hall at Primaciálne námestie 1 or sent by post to the address below. In the case of paper submissions, it is necessary to bring 3 copies of the project documentation. If fewer copies are brought, the application will not be accepted at the registration office.
