Opinion of Bratislava, the capital of the Slovak Republic, on the investment plan
What is the Investment project announcement and when to apply for it?
Bratislava, the capital of the Slovak Republic, allows builders to verify the suitability of the planned land use, namely during the preparation of a specific investment plan, i.e., even before the issuing of a binding opinion and the proceedings taking place at the relevant building authority.
The constructor shall submit the investment plan to the city for consideration along with a request for the city’s opinion on the investment plan. If the submitted architectural study provides sufficient information for a comprehensive assessment of the investment plan, the city shall express its permissibility and suitability on the city’s territory in terms of the established function and intensity of the use of the area defined in the spatial planning documentation.
In the issued opinion, the city shall also indicate the requirements of the assessing expert departments at Bratislava City Hall for the processing of the project documentation required for the zoning decision.
Bratislava issues its opinion on the investment plan through the Investment Guidance Department of Bratislava City Hall. The opinion does not serve as material for proceedings that are then held at the relevant building office. It is advisable to apply for this opinion especially, but not exclusively, in the case of larger investment projects and in the case of complex circumstances in the area in question in terms of the requirements arising from valid spatial planning documentation.
The opinion of the city on the investment plan is issued in paper form and is signed by the mayor of Bratislava as the executive and statutory entity.
What should be included in the application for an Investment project announcement?
Architectonic and transportation plan
Text part of the project documentation
The report shall include the assessment of conformity with the General Plan of Bratislava, the Capital of the SR, for 2007 (ÚPN), as amended, as well as the general plan documentation at the zonal level.
- Layout Drawing
- use the cadastral map to plot the investment plan in the parcel of land and mark the distance between the buildings and from the neighbouring plots of land with spot heights in the map
- clear identification of the construction site on the map – areas which are built up, paved areas and all types of green vegetation (on natural terrain, above underground constructions – graphically differentiated by the thickness of the soil substrate) distinguished by colour, with numerical data on the individual surface areas (in m²)
- the plan must contain a complex assessment of compliance with the ÚPN, i.e., clear identification of the area concerned, borders of the individual functional areas according to the ÚPN; in the event that the area concerned covers several functional areas, it is necessary to prepare a regulation assessment for each functional area separately
- transportation connection of the construction or the area concerned to the road network (indicate all ways in and ways out of the area) and the static transport capacity of the land
- Layout of property ownership only (in the event that the plan affects lands owned by the capital)

Assessment of compliance with the approved general plan documentation
1. compliance with the General Plan of Bratislava, the Capital of the SR for 2007, as amended (ÚPN):
The filing shall contain the assessment of compliance with the valid regulation under the ÚPN, in particular in terms of the intensity of use of the area and the functional use of the area. It is necessary to distinguish whether the construction is in development areas or in stabilised areas of the city.
Indicate the data on the plan’s compliance with the general plan documentation under Section 3 (4) (a) of Regulation No. 453/2000 Coll., including, in particular, the following data on the proposed construction, the area concerned, and the functional area affected:
- in development areas:
- assessment of compliance with the regulation on intensity of use of the development area (IPP, IZP, KZ) of the surface of the area concerned (part of the functional area or construction site) and providing evidence of compliance with the data in the respective regulation charts of the mandatory part of the ÚPN;
- assessment of compliance of the investment plan with the regulation on functional use of areas; in the event of a limited share of a certain function, it is necessary to assess the compliance of the whole functional area;
- in stabilised areas for areas of undeveloped land:
- assessment of compliance with regulation on intensity of use of the stabilised area (IPP, IZP, KZ) of the whole functional area, excluding the plot of land of the investment plan – current situation;
- assessment of compliance with regulation on intensity of use of the stabilised area (IPP, IZP, KZ) of the whole functional area, including the plot of land of the investment plan – future situation;
- assessment of compliance with regulation on intensity of use (IPP, IZP, KZ) of the surface of the areas of interest (part of the functional area or construction site) – future situation;
- assessment of compliance of the investment plan with the regulation on functional use of areas with regulation of functional use of the areas; in the event of limited share of residential surface (functional area codes 201, 202, and 501), it is necessary to assess the compliance of the whole functional area;
- in stabilised areas for (partially) built-up area (also in the case of proposed rehabilitation of current buildings):
- assessment of compliance with regulation on intensity of use of the stabilised area (IPP, IZP, KZ) of the whole functional area, including the plot of land of the investment plan – current situation;
- assessment of compliance with regulation on intensity of use of the stabilised area (IPP, IZP, KZ) of the whole functional area, including the plot of land of the investment plan – future situation;
- assessment of compliance with regulation on intensity of use (IPP, IZP, KZ) of the surface of the areas of interest (part of the functional area or construction site) – current situation;
- assessment of compliance with regulation on intensity of use (IPP, IZP, KZ) of the surface of the areas of interest (part of the functional area or construction site) – future situation;
- assessment of compliance of the investment plan with the regulation on functional use of areas with regulation of the functional use of the areas; in the event of a limited share of residential surface (functional area codes 201, 202, and 501), it is necessary to assess the compliance of the whole functional area.
At the same time, we stipulate that the assessment of compliance of the planned construction in the stabilised area with the approved general plan documentation needs to include the whole functional area affected. Calculations of regulations of intensity of use of the area shall be in the form of charts with the necessary information on every construction and the total calculation of regulations of intensity of use in the functional area affected. The intensity of the planned construction in the stabilised area shall be compared with the calculated regulation values.
For purposes of illustration, it is worth preparing a schematic plan of the functional area affected with the individual constructions.
Informational data on amount of green vegetation on the plot of land if it can be calculated based on the built-up area and access to the functional area.
The share of residential surface area and of community facilities shall be calculated based on gross above-ground surface area in the event of limited residential surface share (functional area codes of 201, 202 and 501).
Calculation of indicators of intensity of use of the area shall be executed based on the following definitions in the ÚPN (Section 2.2.1. Intensity of Use of Functional Areas):
- Index of Floor Surface (IPP) describes the share of total surface area of the floors of above-ground buildings to the total surface of the functional area or its part. It represents the maximum value of use of the area in question. The advantage of this indicator is its clarity and the unequivocalness of the criterion and it is easy to use to express other related indicators, criteria and recommendations.
- Index of Built-Up Surface (IZP) defines the share of the total of built-up area of the functional area or its part to the total surface of the area at hand. It depends on the location and importance of the area concerned, the manner of its functional use, and the type of built-up constructions.
- Green Vegetation Coefficient (KZ) defines the share of respective green vegetation surfaces (natural green vegetation, vegetation above underground constructions) and the total surface of the area in question. The regulation stipulates the minimum green vegetation share on the functional area and is related to the function itself. It depends, in particular, on the mode of the functional use and the location of the development area in the city.
The share of the respective green vegetation areas in the area (m²)=KZ x surface of the functional area (m²).
2. as regards the respective zoning plan (ÚPN Z)
If the area has a valid zoning plan (such areas are indicated with the code “S” in the ÚPN), it is necessary to provide data on the plan’s compliance with the general plan documentation under Section 3 (4) (a) of Regulation No. 453/2000 Coll.. The filing shall include the assessment of compliance with all regulations under the mandatory part of the ÚPN Z (for the respective block, sector, regulation unit etc.).

How to request an opinion on an investment plan
The application (form) must be submitted:
- electronically ↗︎ – the form can be sent together with the necessary attachments after logging into the “Bratislava account”. Attachments must contain a graphic scale and should be in an unlocked and unencrypted .pdf vector format (in exceptional cases in the .dxf format),

- physically – in the case of paper submissions, it is necessary to bring 3 copies of design documentation. Paper applications can be brought physically to city hall at Primaciálne námestie 1 or sent by post to the address below.
